Terms of Service
By accessing or using the eShares platform, you agree to be bound by these Terms of Service. The platform provides tokenized equity management tools including smart contract deployment, token minting, vesting management, and governance services.
Eligibility
You must be at least 18 years of age and legally capable of entering into binding agreements. If using the platform on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Account Responsibilities
You are responsible for maintaining the security of your account credentials and wallet private keys. eShares is not responsible for any loss resulting from unauthorized access to your account or wallet.
Permitted Use
The platform may only be used for lawful purposes in compliance with all applicable laws and regulations. You may not use the platform to facilitate fraud, money laundering, or any illegal activity.
Limitation of Liability
eShares provides the platform on an "as is" basis. To the maximum extent permitted by law, eShares shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.
Privacy Policy
Information We Collect
We collect information you provide directly (name, email, wallet address), information from KYC/AML verification processes, and usage data including transaction history, platform interactions, and smart contract events.
How We Use Your Information
Your information is used to provide platform services, enforce compliance requirements, process transactions, communicate updates, and improve the platform. We do not sell your personal information to third parties.
Data Retention
We retain your data for as long as your account is active or as needed to provide services. On-chain data (token transactions, governance votes) is permanently recorded on the blockchain and cannot be deleted.

You have the right to access, correct, or delete your personal information (subject to legal and regulatory obligations). Contact us at privacy@eshares.com to exercise these rights.
Disclaimers
ESH tokens are utility tokens representing equity interest in domain assets managed through the eShares platform. They are not securities, investment contracts, or financial instruments unless explicitly designated as such under applicable law.
Past performance of any tokenized asset is not indicative of future results. The value of ESH tokens may fluctuate and you may lose some or all of your investment. You should consult with qualified legal and financial advisors before making any investment decisions.
Smart contracts, while audited, may contain undiscovered vulnerabilities. eShares makes no guarantee that the platform or its smart contracts are free from errors or security issues.
Contract Disclosures
All eShares smart contracts are open-source and deployed on Base and BNB Chain networks. Contract addresses and source code are available on our GitHub repository.
Smart contracts are upgradeable through a time-locked governance process. Any proposed contract upgrade requires governance approval and is subject to a mandatory waiting period before execution.
Third-party security audits are conducted by SolidityScan, Hacken, Cyberscope, and Trail of Bits. Audit reports are available in the Security Audits section.
